Terms of Use

Agreement
By downloading or using Noctuary, you agree to these Terms of Use. Your use of Noctuary is also subject to Apple’s Standard Licensed Application End User License Agreement, which is incorporated where applicable.
Acceptable use
Please use Noctuary lawfully and respectfully. You may not misuse the app, interfere with its operation, attempt to gain unauthorized access to it, or use it in a way that violates another person’s rights.
Subscriptions and purchases
Noctuary may offer subscriptions or one-time purchases through Apple’s App Store. Pricing, payment, renewal, cancellation, and refund handling are presented by Apple at the time of purchase and are subject to Apple’s applicable terms. If you have a subscription, you can manage it through your Apple account settings.
Not medical or mental-health advice
Noctuary is designed for personal journaling and reflection. It does not provide medical, psychological, psychiatric, therapeutic, or mental-health advice, diagnosis, or treatment. Please seek qualified professional support for health concerns or urgent help where needed.
Disclaimers and limitation of liability
Noctuary is provided on an “as is” and “as available” basis. To the extent permitted by applicable law, we do not make guarantees about uninterrupted availability, accuracy, or fitness for a particular purpose. To the extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, Noctuary. Nothing in these Terms excludes liability that cannot legally be excluded.
Termination
You may stop using Noctuary at any time. We may suspend or end access where reasonably necessary, including for misuse of the app, to protect users or the service, or where required by law.
Changes to these terms
We may update these Terms from time to time. The current version will be posted here with its effective date. Continuing to use Noctuary after an update means you accept the updated Terms, where permitted by law.
